Agreement to Terms
By accessing or using the services of Lambda Remodeling Services LLC dba The Remodeling Company ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services Description
The Remodeling Company provides professional home remodeling and renovation services throughout Southwest Florida, including but not limited to:
- Kitchen remodeling and renovation
- Bathroom renovation
- Home additions
- Outdoor living spaces
- Whole home remodeling
- Interior renovations
- Flooring installations
All services are subject to written contracts and agreements that will specify the scope of work, timeline, pricing, and other terms specific to your project.
Project Agreements
All remodeling projects require a written contract that will include:
- Detailed description of work to be performed
- Project timeline and milestones
- Total project cost and payment schedule
- Materials and specifications
- Warranty information
- Change order procedures
- Dispute resolution process
The terms of your specific project contract will supersede these general Terms of Service where applicable.
Payment Terms
Payment terms will be specified in your project contract. Generally:
- An initial deposit may be required to begin work
- Progress payments may be scheduled based on project milestones
- Final payment is due upon completion and acceptance of work
- Late payments may incur fees as specified in your contract
- All prices are subject to change orders and additional work requests
Change Orders
Any changes to the original scope of work must be documented in a written change order signed by both parties. Change orders may affect project timeline and cost. Work will not proceed on changes until the change order is approved and signed.
Warranties
We provide warranties on our workmanship as specified in your project contract. Warranties typically cover:
- Workmanship defects for a specified period
- Compliance with building codes and regulations
- Use of quality materials as specified
Manufacturer warranties on materials and fixtures are separate and provided by the manufacturer. Warranty claims must be made in writing within the warranty period.
Licensing and Insurance
We are licensed and insured as required by Florida state law. We maintain general liability insurance and workers' compensation insurance. Proof of insurance and licensing can be provided upon request.
Permits and Inspections
We will obtain all necessary permits and coordinate inspections as required by local building codes. You are responsible for ensuring we have access to the property for inspections and that any required approvals are obtained.
Property Access and Site Conditions
You agree to provide reasonable access to the work site during normal business hours. You are responsible for:
- Ensuring the property is safe for work
- Disclosing any known hazards or conditions
- Obtaining necessary approvals from homeowners associations or other entities
- Securing personal property and valuables
Limitation of Liability
To the maximum extent permitted by law, our liability for any claims arising from our services is limited to the total amount paid for the specific project giving rise to the claim. We are not liable for:
- Consequential, indirect, or incidental damages
- Loss of use or enjoyment of property
- Damages resulting from delays beyond our reasonable control
- Pre-existing conditions not disclosed to us
Intellectual Property
All designs, plans, drawings, and specifications created by us remain our intellectual property unless otherwise specified in your contract. You may use these materials for the specific project but may not reproduce or use them for other purposes without our written consent.
Dispute Resolution
In the event of a dispute, we encourage direct communication to resolve issues. If a dispute cannot be resolved:
- Disputes will be resolved through mediation or arbitration as specified in your contract
- Any legal action must be brought in the state courts of Florida
- Florida state law governs these terms
Termination
Either party may terminate a project contract in accordance with the terms specified in that contract. Termination may result in charges for work completed and materials ordered. Termination procedures will be outlined in your specific project agreement.
Website Use
When using our website, you agree to:
- Provide accurate and truthful information
- Not use the website for any unlawful purpose
- Not interfere with the website's operation
- Respect our intellectual property rights
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. These terms do not affect the terms of existing project contracts.
Severability
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
